Terms of Service

These Terms govern your use of Item Buddy, the storage-inventory app for iPhone, iPad, and Mac. By creating an account or using the app, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and have the legal capacity to agree to these Terms.

2. Your Account

You must provide accurate information, keep your credentials confidential, and are responsible for all activity under your account. We may suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree to use Item Buddy lawfully. You must not upload unlawful content, bypass security measures, reverse engineer the app, distribute malware or spam, or otherwise interfere with the service.

4. Your Content

You retain ownership of the photos, documents, and other content you add to Item Buddy. You grant Datalytic AS a limited, non-exclusive, worldwide, royalty-free licence to host, reproduce, process, transmit, transform, and analyze your content to provide, maintain, secure, and improve Item Buddy.

Where permitted by our Privacy Policy and your applicable privacy choices, this licence includes creating labelled or derived datasets and developing, training, testing, validating, evaluating, and improving machine-learning and computer-vision models and related Item Buddy features, including models designed to operate locally on users' devices.

We do not sell your content, use it for advertising, or license raw user content to third parties as a training dataset. Our processing of personal data is governed by our Privacy Policy. The licence ends when the content is deleted, subject to the limited retention periods, backups, legal obligations, and treatment of previously trained models described in the Privacy Policy.

5. AI Features

Item Buddy automatically analyzes your photos and receipt attachments using automated analysis (Google Gemini) to identify contents and extract receipt details. AI-generated results are not guaranteed to be accurate or complete and should not be relied upon as professional or insurance advice.

This analysis is necessary to provide the AI features you request and is separate from our development of Item Buddy's own models. As described in the Privacy Policy, selected eligible content may be used for Item Buddy model development based on our legitimate interests. You may opt out at any time in Settings without losing scanning, subscription, or other app functionality.

6. Subscriptions and Payments

Item Buddy is free to use for up to 15 counted things. Boxes, items, photos, and standalone receipts each count as one; storage locations do not count, and a receipt attached to an item does not add another count. Item Buddy Pro unlocks unlimited boxes, items, and photos, AI analysis for box photos and receipts, AI-generated tags and categories, and Family Sharing.

• Price and term: Item Buddy Pro is a yearly subscription at the price shown in the App Store at the time of purchase, displayed in your local currency. New subscribers may be offered a free trial; the trial length and terms are shown before you subscribe.
• Billing: Payment is charged to your Apple ID account upon confirmation of purchase.
• Auto-renewal: Your subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period.
• Free trial: If you subscribe during the free trial, any unused portion of the trial is forfeited when the paid subscription begins.
• Managing and cancelling: You can manage or cancel your subscription in your Apple ID account settings. Deleting the app does not cancel your subscription.
• Family Sharing: Item Buddy Pro can be shared with your Apple Family group (up to six members).
• Restoring purchases: You can restore an active subscription at any time from the paywall or Settings.
• Refunds: Purchases made through the App Store are handled by Apple in accordance with Apple's refund policies. Your statutory consumer rights are not affected.

Downgrade: If Pro ends, your existing content — including AI results — stays visible, but you cannot add new content beyond the free limit. We keep all your content during a 90-day grace period; after that, the oldest items exceeding the free limit may be removed.

7. Availability

We do not guarantee that the service will be uninterrupted or error-free, and we may modify or discontinue features.

8. Intellectual Property

Item Buddy and its content are protected by intellectual property laws. You may not copy, modify, or distribute them except as permitted by law.

9. Privacy

Our Privacy Policy governs how we process personal data and forms an integral part of these Terms.

10. Disclaimer of Warranties

The app is provided "as is" and "as available." To the extent permitted by law, all implied warranties are disclaimed.

11. Limitation of Liability

To the extent permitted by law, our liability is limited to the amount you paid in the preceding 12 months or EUR 100, whichever is greater, and we exclude indirect and consequential damages.

12. Consumer Rights

Nothing in these Terms affects your mandatory statutory rights as a consumer under applicable law.

13. Apple App Store Terms

These Terms are between you and Datalytic AS only, not with Apple. Apple is not responsible for the app or its content, and has no obligation to provide support or handle claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Your use of the app must also comply with the Apple Media Services Terms and the standard Apple Licensed Application End User License Agreement (available at apple.com/legal/internet-services/itunes/dev/stdeula).

14. Governing Law

Norwegian law applies. Disputes are subject to the exclusive jurisdiction of the Oslo courts, unless mandatory consumer-protection rules provide otherwise.

15. Changes to These Terms

We will give reasonable advance notice of material changes. Where the law or the nature of a change requires renewed agreement, we will ask you to accept the updated Terms explicitly. Privacy choices and objections are handled as described in the Privacy Policy and are not inferred merely from continued use.
